Hyperliquid’s native token ($HYPE) responded with confident growth to the historic decision of the U.S. Commodity Futures Trading Commission (CFTC), which for the first time allowed trading of perpetual futures on individual stocks (Equity Perpetuals).
The regulatory shift de facto legitimizes a product that developed predominantly in DeFi ecosystems and opens the way for the institutional expansion of Hyperliquid’s infrastructure, which served as the trigger for the asset’s rally.
According to the CFTC release of November 3, 2026, equity perpetual contracts received the status of security futures under joint CFTC and SEC oversight, with the possibility of trading on dual-registered exchanges.

Today, equity perps can begin trading for the first time on @CFTC registered exchanges. This move reflects my commitment to ensuring that America’s markets remain the most innovative, liquid, and well-regulated in the world. Instead of being forced to turn to offshore, unregulated venues to access equity perpetual futures, Americans may now access equity perps on CFTC-regulated markets subject to robust safeguards. I appreciate the continued partnership of @SECGov and @SECPaulSAtkins as we work to further harmonize our agencies' regulatory initiatives.

The agency’s goal is to bring back into the U.S. legal field billions in volume that had been flowing to offshore crypto platforms. The instrument is being launched under the Commodity Futures Modernization Act of 2000 (CFMA), which eliminates the need to pass new laws.
Why U.S. authorities needed to legalize an instrument invented in DeFi
The regulator’s pragmatic step directly boosts Hyperliquid’s capitalization. Through its HIP-3 framework (in particular, the trade[XYZ] platform), the project already controls the largest on-chain market for perps on Apple, Nvidia and Tesla, with daily turnover in the hundreds of millions of dollars.
The new CFTC classification fully matched the structure that the Hyperliquid Policy Center advocated in official submissions to the authorities.
Now financial giant ICE (owner of the NYSE), which previously invested in trade[XYZ], gets a legal basis for creating a regulated American platform on Hyperliquid technology, while Payward (Kraken’s parent company) is accelerating the launch of a similar product through the regulated exchange Bitnomial.
Despite legalization in the U.S., Hyperliquid maintains a strict geoblock for American residents, continuing to serve the global market thanks to its key trump cards: on-chain liquidity, 24/7 trading and flexible margin conditions.
Local exchanges in the U.S. will inevitably face the limitations of traditional Wall Street sessions and strict SEC leverage limits in the early stages.
This moves Hyperliquid from the status of an offshore experiment into the role of the main technology donor of the American financial market, with the possibility of monetizing its infrastructure through fee opportunities from the trades of regulated partners.
