Bitcoin Wallet Fails to Comply with Canadian Court Order to Freeze Funds.

The Superior Court of Justice of Ontario, Canada, issued an injunction from Mareva, the Nunchuk cryptocurrency company, of a self-custody Bitcoin wallet, froze its assets, and obtained information about assets associated with the Freedom Convoy 2022 campaign. In addition, many activists were blocked after protests against Covid-19 in previous weeks in Ottawa, and Prime Minister Justin Trudeau used the Emergency Act to cover cryptocurrency transactions.

The company responded, arguing that forcing it to comply is technologically impossible in court cases. “Collaborative, self-custodial multi-sig Bitcoin wallet,” says Nunchuk in an official response to the Ontario Superior Court of Justice. “Software provider, not financial custody intermediary.”

The company said it complied with all Canadian laws and legislation but declined to provide the government with more information. “At this time, we are unable to provide further details without significantly compromising our systems and security,” the company said in court documents. The company also noted that freezing its funds would make it difficult to operate with customers worldwide.

When the Royal Canadian Mounted Police (RCMP) National Police Force of Canada ordered all FINTRAC-regulated companies to avoid involvement with 34 cryptocurrency wallets associated with Trucker’s Freedom Convoy, the legitimacy of this claim was put to the test. Likewise, following GoFundMe’s decision not to fork out the $9 million collected on its website, bitcoin has become one of the most effective means of giving to truckers.

Nunchuk said in a statement that “Bitcoin transactions cannot be reversed and have not been considered reversible. The only information we obtain about our users is their email addresses. No keys are in our possession either. Therefore, we cannot “freeze” our client’s assets. We have no way of stopping them from moving. Our user’s assets are unknown to us regarding “presence, type, value, and location.” Although Nunchuk is registered in Canada, it operates as a global Bitcoin business and can quickly work outside the country.
