A Florida court appeals for the charges dismissal to local Bitcoin trader one and half year ago to be reversed.
One and half year after a judge of the 11th Judicial Circuit of Florida dismissed the charges to a local Bitcoin trader, Michell Espinoza who was arrested after selling Bitcoin to undercover agents, the state’s 3rd District Court appeals for the decision to be reversed.
To recap, the Miami police department who worked with the US Secret Service implied that Espinoza planned to use the coins to buy stolen credit cards and accused him for money laundering and illegal money transmission.
Judge Teresa Mary Pooler, on the other hand, didn’t seem to agree as she thought that Bitcoin is not legally considered as money in the state of Florida.
Nonetheless, the appeal proposal stated, “The trial court erred in dismission Count 1 because Espinoza acted as both a money transmitter and a payment instrument seller and, as such, was required to register with the State of Florida as a money services business.”
Under Florida law, the activities Espinoza conducted required a registration as a money services business, as reported by Bitcoin Exchange Guide.
Given the recent update, the trial court will now hear the case, something that wasn’t done previously as the case was dismissed before ever going to trial.
