SEC Lawsuit No Longer Excuse for Poor XRP Price Performance

Pro-$XRP lawyer Bill Morgan has argued that the SEC lawsuit can no longer serve as an excuse for $XRP’s disappointing price performance.

In an X post, he noted that the coin has continued to decline despite the legal dispute’s resolution. Specifically, Morgan said $XRP had fallen 45% over the past 12 months and approximately 60% since the litigation with the U.S. Securities and Exchange Commission (SEC) was resolved on August 7, 2025.

“The lawsuit cannot be an excuse all the time for $XRP’s current price. That excuse is getting quite old,” Morgan wrote.

He described the legal dispute as an “overrated and exaggerated excuse,” arguing that positive developments in the case often lifted $XRP’s price temporarily, but those gains were largely reversed afterward.

Morgan Questions Lasting Impact of SEC Lawsuit Resolution

Morgan acknowledged that favorable developments in the lawsuit had positively affected $XRP’s price. However, he argued that these reactions were short-lived and failed to translate into sustained gains.

According to the lawyer, even the resolution of the case did not produce a lasting positive effect on $XRP’s market performance. For instance, $XRP traded above $3.6 in July 2025. By the time the cases ended in August 2025, the price was already reversing and has remained so since then.

Morgan also suggested that anticipation surrounding the settlement had a greater impact on the token’s price in the months leading up to the resolution. Much of that price appreciation, however, has since reversed, as $XRP is trading 60% below the price at the time.

Essentially, Morgan’s comments challenge the argument that regulatory uncertainty remains the primary explanation for $XRP’s underperformance.

“SEC Lawsuit Held Back by $XRP”

Morgan’s remarks came in response to $XRP influencer Digital Asset Investor, who argued that $XRP’s legal battle with the SEC set it apart from other major cryptocurrencies.

Digital Asset Investor pointed out that $XRP was the only digital asset on a referenced list to face a five-year SEC lawsuit. He claimed that $XRP had previously surpassed Ethereum and was moving toward Bitcoin before the legal attacks began.

Reflecting on conversations with Ripple representatives at Evernorth’s Nasdaq listing, the influencer said he received a clear message that the obstacles facing the company had been removed.

“All roadblocks have been removed,” he wrote.

The post followed data showing $XRP trading around $1.33, approximately 62.5% below its January 2018 peak. Meanwhile, Bitcoin, Ethereum, and several other top cryptocurrencies are trading far above their 2017/2018 highs.

The only digital asset on that list to undergo a 5 year SEC lawsuit is $XRP. $XRP passed Ethereum and was headed for Bitcoin and then the attacks began. When I was at the Evernorth listing at NASDAQ there was one clear message from conversations with Ripple. All roadblocks have… https://t.co/NkPFCS2R6y

$XRP Faces Questions Post-Lawsuit

The divergent opinions in the $XRP community show how much responsibility the SEC lawsuit bears for the token’s price performance.

While Digital Asset Investor maintains that the legal battle placed $XRP at a disadvantage compared with other top cryptocurrencies, Morgan believes the lawsuit cannot indefinitely explain $XRP’s struggles, especially since its resolution failed to deliver lasting price gains.
